Their biggest problem is working out who's going to be the one to bring Leroy his breakfast in the morning before they let him leave after sobering up. So he's not quite sure where all this paperwork comes from. But of course Regina expects it to be done, and the monthly report too, so she can present that to the city council (which he's pretty sure is supposed to be his job, as the sheriff, but somehow she always ends up doing it).
It's when Emma falls asleep that he decides that maybe the rest of this can wait until tomorrow. They'll have a few hours yet, and if they try and keep doing it now, when it's this late and they're this tired, there are bound to be mistakes. Which just means doing it over again anyway.
He puts the form down and adjusts his position on the couch to make it less likely to wake her up. Obviously she needs the sleep.
